Please read these Terms of Service ("Terms") carefully before using the ImageWand website and services operated by ImageWand ("us", "we", or "our").

2. Description of Service

ImageWand provides AI-powered image editing tools, including but not limited to background removal, image upscaling, and enhancement. The Service is provided on a credit-based system.

3. User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Content and Conduct

You retain all rights to the images you upload to ImageWand. By uploading content, you grant us a temporary license to process and host that content solely for the purpose of providing the Service to you.

You agree NOT to use the Service to:

  • Upload any content that is illegal, harmful, threatening, abusive, harassment, defamatory, vulgar, obscene, or libellous.
  • Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Distribute viruses, malware, or any other harmful computer code.

We reserve the right to terminate your account if you violate these guidelines.

5. Credits and Payments

  • Credits: Our Service operates on a credit system. Credits are purchased securely via Stripe.
  • Refunds: Purchases of credits are generally non-refundable. If you believe there has been an error in billing, please contact support.
  • Pricing: We reserve the right to change our pricing at any time. Any changes will not affect credits you have already purchased.

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of ImageWand and its licensors.

7. Limitation of Liability

In no event shall ImageWand, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the results of the AI processing will be accurate or meet your specific requirements.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
